Terms of Service

These Terms of Service ("Terms") govern your use of findpoolowners.com and the FindPoolOwners data product (collectively, the "Service"), operated by Langley Ventures LLC, a Texas limited liability company ("we," "us," "our").

By accessing the Service or purchasing a list, you agree to be bound by these Terms.

1. The Service

FindPoolOwners aggregates property records published by U.S. county appraisal districts and tax assessors and sells filtered subsets — specifically, lists of single-family homes containing swimming pools — to business customers for use in direct marketing.

2. License you receive when you purchase

When you purchase a list, we grant you a non-exclusive, non-transferable, perpetual license to use the data in that specific CSV for your own business's marketing activities, including but not limited to:

• Direct mail (postcards, letters, brochures) to the listed property addresses
• Door-to-door sales canvassing
• Internal CRM import for tracking outreach
• Cross-reference with your own customer database

You may use the list multiple times for your own business. You may share the file internally with your employees and contractors who work on your marketing.

3. Data accuracy — no warranty

All property records are sourced from public county appraisal districts. We refresh monthly but cannot guarantee 100% currency or accuracy. Specifically:

• Ownership changes typically appear 30-60 days after recording
• Pools added recently may not yet appear in the underlying data
• CAD records occasionally contain errors (wrong year built, misspelled names, etc.)
• Mailing addresses may be outdated if the owner relocates

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. Your use of the data is at your own risk.

4. Pricing and payment

Pricing is shown at the point of purchase and varies by selected area, radius, and any optimization filters applied. Current rates:

• ZIP-code purchases: $0.10 per pool home in the ZIP
• Radius purchases: $0.20 per pool home in the radius
• Optimization filter: $39 per list, includes unlimited refiltering of that list for one year

Payment is processed by Stripe, Inc. We don't store your card information. All purchases are in U.S. dollars. Pricing may change for new purchases at any time; existing purchases are unaffected.

5. Refund policy

Because lists are delivered instantly as digital files, sales are generally final. We will issue a full refund when:

• You purchased the wrong county or ZIP by mistake and notify us within 24 hours, before downloading the file
• The delivered file is defective (wrong county, blank rows, corrupted file)
• A duplicate purchase was made due to a website error

For refund requests, email [email protected] within 7 days of purchase. Beyond those scenarios, we generally can't reverse a delivered list — once you have the data, the transaction is complete on our end.

6. Compliance with applicable laws

You are solely responsible for ensuring your use of the data complies with applicable laws, including but not limited to:

• Direct mail: generally legal in all U.S. states.
• TCPA (Telephone Consumer Protection Act): prohibits unsolicited SMS/calls to consumers without prior express consent. We do not deliver phone numbers, but if you append phone data from a third party, TCPA applies.
• CAN-SPAM Act: applies to commercial email. We do not deliver email addresses.
• Local "Do Not Knock" registries: if you door-knock, check local ordinances.
• FCRA: if you use property data to make consumer credit, insurance, or employment decisions, you may need FCRA-compliant processes. Our data is NOT delivered as a "consumer report" under FCRA.

7. Privacy

8. Account suspension / refusal of service

We may refuse service or suspend access if you:

• Violate these Terms
• Resell or attempt to resell the data
• Use the data for illegal purposes
• Engage in fraudulent payment behavior or chargebacks
• Abuse the Service through automated scraping or excessive purchases for bulk resale

9. Limitation of liability

To the maximum extent permitted by law, in no event will Langley Ventures LLC, FindPoolOwners, or our owners, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or business interruption, arising out of or in connection with your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold us harmless from any claim, damage, or expense (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms or applicable law.

11. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Any dispute arising out of these Terms or the Service will be resolved in the state or federal courts located in Tarrant County, Texas, and you consent to that jurisdiction and venue.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date at the top. Continued use of the Service after changes constitutes acceptance.
